1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and mottosoup ("we," "us," or "our") governing your access to and use of the mottosoup.com website, platform, and related services (collectively, the "Service").
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Description of Service
mottosoup is a multi-tenant manga and comic publishing platform that allows creators to:
- Create and manage publishing teams
- Upload, organize, and publish manga and comic content
- Host content on customizable subdomains or custom domains
- Track readership statistics and engagement
- Build and engage with their reader community
3. Account Registration
3.1 Account Creation
To use certain features of the Service, you must create an account. You may register using your email address or through Google OAuth authentication. You agree to provide accurate, current, and complete information during registration.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other security breach.
3.3 Account Requirements
You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.
4. User Content
4.1 Ownership
You retain all ownership rights to the content you upload, publish, or otherwise make available through the Service ("User Content"). mottosoup does not claim ownership over your User Content.
4.2 License Grant
By uploading or publishing User Content, you grant mottosoup a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting and display purposes), and distribute your User Content solely for the purpose of operating and providing the Service. This license terminates when you delete your User Content or account, except for content that has been shared with others who have not deleted it.
4.3 Content Responsibility
You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that:
- You own or have the necessary rights to use and authorize the use of your User Content
- Your User Content does not infringe any third party's intellectual property or other rights
- Your User Content complies with these Terms and all applicable laws
5. Prohibited Content and Conduct
You agree not to upload, publish, or transmit any content that:
- Infringes any copyright, trademark, or other intellectual property rights
- Contains unauthorized copies of copyrighted manga, comics, or other works
- Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Contains sexually explicit content involving minors
- Promotes violence, discrimination, or hatred against any individual or group
- Contains malware, viruses, or other harmful code
- Is fraudulent, deceptive, or misleading
- Violates any person's privacy or publicity rights
You also agree not to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service or servers
- Use automated means (bots, scrapers, etc.) to access the Service without permission
- Circumvent any rate limiting, access controls, or security measures
- Engage in any activity that could damage, disable, or impair the Service
- Impersonate any person or entity or misrepresent your affiliation
6. Teams and Collaboration
6.1 Team Creation
Users may create teams to organize and publish content. The team creator becomes the Owner and has full administrative control over the team.
6.2 Team Roles
Teams support different roles (Owner, Admin, Member) with varying permissions. Team Owners are responsible for managing team members and ensuring all team content complies with these Terms.
6.3 Team Responsibility
Team Owners and Admins are responsible for the content published by their team. We may suspend or terminate teams that repeatedly violate these Terms.
7. Custom Domains
We provide subdomain hosting (yourname-team.mottosoup.com) free of charge. You may also connect your own custom domain to your team. When using a custom domain:
- You must own or have authorization to use the domain
- You are responsible for domain registration, renewal, and DNS configuration
- We are not responsible for domain-related issues outside our control
8. Subscriptions and Payments
8.1 Free and Paid Plans
We offer a free tier with unlimited basic features and paid Pro subscriptions with additional premium features. Current pricing is available on our Pricing page.
8.2 Billing
Pro subscriptions are billed monthly or annually in advance. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Payments are processed by Creem, who acts as the Merchant of Record.
8.3 Cancellation and Refunds
You may cancel your subscription at any time. Upon cancellation, you will retain access to Pro features until the end of your current billing period. Refunds are handled by Creem as the Merchant of Record. We do not provide refunds for partial billing periods.
8.4 Price Changes
We may change subscription prices with 30 days' notice. Pre-sale pricing is locked in for subscribers who maintain an active subscription.
9. Intellectual Property
9.1 Our Intellectual Property
The Service, including its design, features, and content (excluding User Content), is owned by mottosoup and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.
9.2 Trademarks
"mottosoup" and our logos are trademarks of mottosoup. You may not use our trademarks without prior written permission.
10. DMCA and Copyright Policy
We respect intellectual property rights and expect our users to do the same. We will respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA).
If you believe your copyrighted work has been infringed, please send a DMCA takedown notice to [email protected] with:
- Identification of the copyrighted work claimed to be infringed
- Identification of the infringing material and its location on our Service
- Your contact information
- A statement that you have a good faith belief that use of the material is not authorized
- A statement that the information is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner
- Your physical or electronic signature
We may terminate accounts of repeat infringers.
11. Fair Use Policy
While we offer unlimited resources on our free tier, this is subject to fair and reasonable use. We reserve the right to limit or suspend accounts that:
- Upload excessive amounts of content in a manner that strains our infrastructure
- Use automated tools for mass uploads without authorization
- Attempt to use the Service for purposes other than manga/comic publishing
- Negatively impact service quality for other users
12. Termination
12.1 Termination by You
You may terminate your account at any time by contacting us at [email protected]. Upon termination, your right to use the Service will immediately cease.
12.2 Termination by Us
We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to:
- Violation of these Terms
- Conduct harmful to other users or the Service
- Requests by law enforcement or government agencies
- Extended periods of inactivity
- Discontinuation or modification of the Service
12.3 Effect of Termination
Upon termination, your User Content may be deleted. We are not obligated to retain or provide you with copies of your User Content after termination. We recommend maintaining your own backups.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant the accuracy, completeness, or reliability of any content obtained through the Service.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOTTOSOUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, WHETHER ARISING FROM CONTRACT, TORT, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
15. Indemnification
You agree to indemnify, defend, and hold harmless mottosoup and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your User Content
- Your violation of these Terms
- Your violation of any third party's rights
16. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
If you do not agree to the modified Terms, you must stop using the Service and may terminate your account.
17. General Provisions
17.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and mottosoup regarding the Service.
17.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
17.3 Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
17.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
17.5 Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
